€9,400,000 settlement for paraplegic child injured during scoliosis spinal surgery

We secured a €9,400,000 personal injury compensation settlement for a very deserving young child who became paraplegic following scoliosis surgery in CHI at Crumlin.

This was a most complex case, in which we retained a leading Consultant Spinal Surgeon from Chicago, along with a leading Consultant Musculoskeletal Radiologist from the UK to prepare expert reports, alongside a range of other specialist experts.

Our Senior Legal Executive, Grace Carroll, travelled to Chicago to meet with the Consultant Spinal Surgeon in person. This educational trip allowed her to obtain an in depth understanding of the issues at hand, and she brought that knowledge back to our office in Dublin.

Concurrently, our Consultant Musculoskeletal Radiologist undertook a forensic investigation of the radiology imaging with the use of of highly specialised review software. Following his investigation, the Consultant Radiologist was of the view that the imaging showed that a surgical screw was misplaced into the child’s spinal cord.

Our Senior Counsel was extremely committed to achieving the best possible outcome in this case, which was strongly fought by the HSE (liability was fully denied).

We are so thrilled to have been able to achieve this settlement through mediation during the Covid-19 pandemic. The child’s parents are now be able to arrange for high level care to be provided to their young daughter, and hopefully the family’s quality of life will much improve. This was one of our most emotional success stories, and the family will always remain close to our hearts.
