We secured a cerebral palsy settlement of €4,500,000 for a young man. The Plaintiff was born prematurely at 28 weeks, which caused him to sustain a brain injury and he was diagnosed with cerebral palsy.
The Plaintiff alleged that his premature birth and cerebral palsy were caused and/or materially contributed by negligent medical care. The hospital failed to diagnose the mother’s pregnancy and she subsequently received a series of genealogical treatments, which are not appropriate in pregnancy. We engaged three separate consultant doctors who concluded that these inappropriate treatments caused the Plaintiff’s premature birth and consequent brain injury.
The Plaintiff has quadriplegic cerebral palsy and developmental delay. His capacity for independent living was destroyed and he is wholly dependent on special care and supports for most of the activities of daily living, and he will continue to be so dependent for the rest of his life.
The case was fully defended, however, together with our team of Counsel, we were able to establish a number of negligent factors in the care and treatment of the Plaintiff and his mother.
Following the settlement of the case, the Plaintiff was able to purchase a beautiful state of the art accessible home, which he truly deserves. He is now cared for by a team consisting of both his family and private carers.
This Plaintiff is an absolute gentleman, who we all have a soft spot for. He never complained throughout his ordeal, which is rather extraordinary as we took this file over from another firm of solicitors, who sat on his case for almost 17 years. From the time we took the case over, the case was settled within a year.
