Personal Injury Claims Process

McMahon Goldrick Solicitors have over 45 years. experience with the personal injury claims process.

Introduction to the Personal Injury Claims Process

At McMahon Goldrick Solicitors, we prioritise making the personal injury claims process as seamless and stress-free as possible for our clients.

Step 1: Initial Contact and Case Evaluation

  • Initial Consultation: Reach out to us and speak directly with a dedicated solicitor from McMahon Goldrick. Your case will receive a thorough evaluation.
  • Time Sensitivity: Adults over 18 must file an injury claim within 2 years minus 1 day from the injury date, with limited exceptions. If the injured person is a child, a parent or guardian can file a claim anytime before the child turns 18. After turning 18, the young adult has the same 2 years minus 1 day timeframe to file a claim independently.
  • Make A Note Of The Incident: If you can, you should write down all the details that you can recall in respect of when and how the injury occurred. This can be a particularly difficult exercise to do after experiencing such a traumatic event, but it will be of benefit to your claim. It will assist your solicitors with the process of taking your formal instructions. A loved one can help with this exercise.

You should make a note of the following:

    • What you were doing on the day of the accident or injury
    • The timing of those activities
    • How the accident occurred
    • Who you were with
    • What medical services you immediately received, etc.

The sooner you write down those details the better.

Step 2: Providing Expert Insight

Case Strength Assessment: We offer an expert analysis of the strength of your case, including an estimated compensation value.

Guided Decision Making: If you choose to move forward, we will supply detailed paperwork, explaining the entire process.

In-Depth Discussion: Following the receipt of the independent medical report, we will discuss its contents with you, offering our professional opinion on the likely outcome of your case and the expected timeframe.

Step 3: Record Collection

Medical Record Collection: Should your case show potential, we will proceed to collect all relevant medical records.

Expert Medical Review: These records are then reviewed in detail by our Medical Consultants, who provide a professional opinion on liability. In Ireland, securing a medical report confirming negligence is a crucial step in initiating a medical negligence claim.

Step 4: Initiating the Claim

Efficient Process Management: The team at McMahon Goldrick Solicitors takes charge of most of the process, ensuring minimal time commitment from you.

Claim Notification: We issue a letter of claim to the defendant, informing them of your intention to seek compensation for your injury.

Comprehensive Assessment: You will undergo a medical assessment to gauge the extent of your injury. We also evaluate any loss of earnings and additional expenses, with the aim of recovering these costs.

Legal Proceedings Initiation: If we decide to proceed, our team handles the issuance and serving of legal proceedings on the defendants, streamlining the process for you.

McMahon Goldrick Solicitors is committed to guiding you through the claims process with expertise, care, and minimal disruption to your life, ensuring you are fully informed and supported every step of the way.
